Terms & Conditions

  1. Definitions
  • Big Dog: Refers to Big Dog Event Group PTY LTD (ABN 93668 157935), including its employees and agents.
  • Hirer: The person or entity renting equipment from Big Dog.
  • Equipment: The items rented from Big Dog to the Hirer.
  • Contract: The document specifying the Equipment being rented, which includes these Terms & Conditions.
  • Invoice: The document detailing the Equipment rented and the associated charges.
  1. Conditions of Hire
  • The rental period begins on the date specified in the Contract or Invoice and lasts for the agreed term, unless terminated earlier as per these terms.
  • The Hirer may use the Equipment for the rental period and any agreed extensions.
  • The Hirer must not move the Equipment from its original location without Big Dog's permission.
  • The Hirer acknowledges receiving proper instructions on how to use the Equipment.
  • The Hirer is responsible for the Equipment from the time of delivery until it is collected or returned to Big Dog.
  1. Payment
  • The Hirer agrees to pay the rental fee and any applicable charges, including GST, for the rental period.
  • A 50% deposit is required upon confirming a quote, with the balance due 3 days before the rental period starts, unless otherwise agreed.
  • Orders placed within 7 days of delivery require full payment to confirm the booking.
  • All prices are in Australian Dollars (AUD).
  • Full payment is required upfront for custom-built or specially purchased equipment.
  • Additional charges for loss, damage, or repairs must be paid within seven days of receiving an additional invoice.
  • The Hirer agrees to cover any expenses Big Dog incurs due to a breach of these terms, including legal fees.
  • Big Dog may offer rebates or commissions to event organizers related to the equipment rental.
  • The Hirer agrees to provide credit card details for payment before equipment delivery.
  1. Termination
  • Big Dog may terminate the rental at any time, and the Hirer has no claims for such termination.
  • The Hirer may terminate the rental by notifying Big Dog that the Equipment is ready for collection, keeping it safe until then. Upon termination, Big Dog may immediately repossess the Equipment, and the Hirer authorizes Big Dog to enter the premises to do so.
  • If the Equipment is not ready for pickup at the end of the rental period, the Hirer must pay an additional 100% of the daily rate for each extra day.
  1. Cancellation
  • Cancellations may result in forfeiture of hire fees:
    • 4 weeks before the event: Full refund minus 20% of the deposit.
    • 1-3 weeks before the event: Forfeit 30% of the total hire fee.
    • Within 7 days of the event: Forfeit 100% of the total hire fee.
  1. Delivery & Collection
  • The Hirer must allow Big Dog access to the Equipment at all reasonable times.
  • The Hirer must provide safe and proper access to the event site.
  • The Hirer is liable for any injury, loss, or damage suffered by Big Dog or its representatives at the event site.
  • Extra charges may apply for delivery to non-street-level locations.
  1. Damage
  • The Hirer is responsible for the Equipment from delivery until collection and must pay for any damage or loss.
  • A 5% damage waiver covers normal wear and tear but does not cover damage from misuse, disappearance, or unknown causes.
  • The Hirer must protect the Equipment from the elements until it is collected.
  • Any person signing on behalf of the Hirer guarantees they have the authority to bind the Hirer to this agreement.
  • If multiple people hire the Equipment, they are jointly and severally liable.
  • By confirming a quote, paying a deposit, or making a booking, the Hirer agrees to these Terms and Conditions.
  • If the Equipment is damaged, the Hirer may have the option to purchase it.
  1. Property
  • Big Dog retains ownership of the Equipment at all times. The Hirer’s interest is only as a bailee.
  • Big Dog may inspect the Equipment during the rental period without notice, and the Hirer must cooperate.
  1. Insurance
  • The Hirer must maintain insurance for theft and damage to the Equipment at full replacement value.
  • The Hirer must also carry liability insurance to protect Big Dog and its Equipment.
  1. Force Majeure
  • Force Majeure refers to events beyond the control of either party, like natural disasters, war, or government actions.
  • Neither party is liable for delays or failures to perform due to Force Majeure, and Big Dog is not responsible for indirect or consequential losses.
  1. Release & Indemnity
  • The Hirer releases Big Dog from liability and agrees to indemnify Big Dog against third-party claims arising from the use of the Equipment.
  1. Miscellaneous
  • The Hirer must ensure the site is clear for Big Dog to set up the Equipment safely.
  • Failure to enforce any term does not waive Big Dog's rights.
  • These Terms are governed by the laws of Victoria, and both parties submit to the jurisdiction of Victoria's courts.
